A natural person (a third-country foreigner or a citizen of the EU/EEA or Switzerland)

A natural person (a third-country national or a citizen of the EU/EEA or Switzerland) who performs illegal work is committing an offence for which a fine of up to CZK 100,000 may be imposed under the Employment Act.

A natural person (a third-country national or a citizen of the EU/EEA or Switzerland) staying in the workplace of the inspected person who performs work and does not prove their identity with an ID card or travel document, is committing an offence for which a fine of up to CZK 200,000 may be imposed under the Employment Act.

A natural person (the employer)

A natural person who allows someone to perform illegal work is committing an offence for which a fine of up to CZK 5,000,000 may be imposed under the Employment Act.

A natural person is committing an offence even if, under the Employment Act, they fail to comply with the notification obligation or do not keep the records stated in this Act., A fine of up to CZK 100,000 may be imposed for committing these offences.

A natural person is also committing an offence if, under the Employment Act, there is no copy of the documents proving the existence of a labour relationship at the place of work. The offence is punishable in the form of a fine of up to CZK 500,000.

A legal person or a business owner (an employer)

A legal person or a business owner who allows someone to perform illegal work is committing an offence for which a fine of up to CZK 10,000,000, at least CZK 50,000 may be imposed on an employer under the Employment Act.

A legal person is committing an offence even if, under the Employment Act, they fail to comply with the notification obligation or do not keep the records stated in this Act. A fine of up to CZK 100,000 may be imposed for committing these offences.

A legal person or a business owner is also liable to commit an offence if, under the Employment Act, there is no copy of the documents proving the existence of a labour relationship at the place of work. The offence is punishable in the form of a fine of up to CZK 500,000.

In determining the amount of the fine imposed on a natural or a legal person, the gravity of the offence shall be taken into account.

Offences are dealt with and fines imposed by the State Labour Inspection Authority or the Regional Labour Inspectorate in accordance with the Employment Act.

Illegal work means:

  • dependent work of a natural person outside the labour relationship;
  • work performed by a foreigner contrary to the work permit issued or without it, or in contradiction to an employee card, an internally transferred employee card or a Blue Card or without one of these cards; (this does not apply in the case of transfer to another job under the Labour Code), or
  • work performed by a foreigner for a legal or a natural person without a valid residence permit in the Czech Republic.
